Business Purchase Terms
Please read the ShopsKB Business Purchase Terms (the Business Purchase Terms) carefully to ensure that you are fully aware of your rights and our obligations to you when making a booking via the ShopsKB website, which is displayed at www.ShopsKB.com (the Website).
The following bookings are Business Bookings:
- Tour Operator Bookings - where a tour operator, whether in Australia or overseas, makes a booking;
- Wholesaler Booking - where a wholesaler, whether in Australia or overseas, makes a booking;
- Travel Agent Booking - where a travel agent, whether in Australia or overseas, makes a booking; and
- Tour Leader/Tour Guide Booking - where a Tour Leader/Tour Guide, whether in Australia or overseas, makes a booking; and
- Out of Inventory Booking - when any part of the booking, regardless of who has made the booking, exceeds ShopsKB’s display inventory.
Reference to Booking Participants refers to those participants of a Business Booking.
Your completion and submission of your Business Booking signifies your agreement to be bound by the Business Purchase Terms, which constitute an agreement between G Trip Express Pty Ltd ACN 151 140 135 (ShopsKB) and you. By agreeing to the Business Purchase Terms, you acknowledge that all Booking Participants agree to be bound by similar terms. Any variation of the Business Purchase Terms must be in writing and signed by a representative of ShopsKB.
By making a Business Booking, you acknowledge and warrant that you are at least 18 years of age, and agree to be bound by the Business Purchase Terms.
PURCHASES
We provide various travel related services on behalf of third party travel service suppliers (Suppliers). Our obligation is to make Shopping bookings on your behalf and to arrange relevant contracts between you and the Suppliers.
The person making a Business Booking via the Website will be deemed to have accepted the Business Purchase Terms on behalf of the persons or business entities named in the booking form (if different from the person making payment).
You must provide full and accurate personal details at the time of making your booking or purchase. You may be required to provide additional details upon request.
All participants of a Business Booking must be at least 18 years of age.
Booking commission rate
The booking commission rates quoted on the Website it is a standard of that Supplier provided, actual commission rate of each Supplier (store) is subject to your agreement with that company.
FEES AND CHARGES
There are no initial booking fees for the business booking via ShopsKB to our supplier. You will be responsible for any fees or charges that Supplier (Store) incurs as a result of a late booking in addition to any late booking fee.
You are solely responsible for any charges incurred by your banking or financial institution as a result of your Business Booking.
BOOKING COMMISSION PAYMENT
Supplier (store) will settle their commission payment to the booking within 48 hours unless have other agreement with your company.
ShopsKB IS NOT RESPONSIBLE AND ANY OBLIGATIONS OF THE COMMISSION PAYMEN FOR THE BUSINESS BOOKING (IN BETWEEN BUYER AND SELLER).
SUPPLIER REFUND POLICY
By agreeing to and accepting the Business Purchase Terms, you also agree to the terms of the each supplier (store) refund policy.
PROCESSING OF BOOKINGS
Once you make a booking to the supplier via Shopskb.com, it will subject to supplier responsible of the booking.
REFUSAL OF CARRIAGE
ShopsKB retains the right to remove a Booking Participant from participating in a Business Booking for reasons that impact on the enjoyment or safety of other Booking Participants, such as, but not limited to, a Booking Participant’s physical, medical or mental inability to undertake the arrangements of the tour, unsocial or unruly behaviour, or the carriage of prohibited substances and materials.
CHANGES TO VISIT THE STORE
There may be circumstances beyond our control that require us to change a Business Booking. We reserve the right to change a Business Booking, and will endeavour to inform you of any change as soon as reasonably possible.
SUPPPLIER REFUND POLICY
Each supplier (store) have a own refund policy, you must aware of their refund policy before make a booking, once make a booking which mean you are accept that supplier refund policy and purchase term.
After Commencement of Business Booking
We strongly recommend that Booking Participants travel with emergency funds in the event that a Business Booking is changed after commencement of the Business Booking. We will not be responsible for any incidental expenses incurred as a result of a change of the Business Booking.
AGENCY
We act as an agent only. No partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended to be created between you and us by the Business Purchase Terms. We do not make or give any warranty or representation regarding the of the Suppliers’ services.
LIABILITY
To the fullest extent permitted by law, we do not accept:
- any liability of whatever nature, whether in contract, tort of otherwise, for the acts, omissions or default, whether negligent or otherwise, of Suppliers;
- any liability of whatever nature, whether in contract, tort or otherwise, for any injury, damage, loss (including consequential loss), death, delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control and is not preventable by reasonable diligence on our part; and
- any liability of whatever nature, whether in contract, tort or otherwise, for any injury, damage, loss (including consequential loss), death, delay, additional expense or inconvenience Booking Participants suffer, directly or indirectly, in connection with, or arising out of, participation in a tour, or any breach of the Business Purchase Terms.
- false advertising, privacy breaches or slander contained in Product Information;
- any inconsistency, disagreement, contradiction or variation of a word or phrase translated into a language other than English;
- the Supplier’s negligence or wilful misconduct or that of the Supplier’s employees or agents.
INDEMNITY
You agree to indemnify us (including our officers, employees, shareholders, agents, affiliates, associated entities or other representatives) from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses (whether in tort or in contract including and without limitation, negligence) arising out of or in any way connected to your Business Booking.
JURISDICTION
The laws of Queensland, Australia, govern this agreement.
